§ 12-36. Fees for responding to at-fault alarms.

  • Every alarm system user shall pay to the village a fine, as hereinafter provided, for each false alarm response in excess of two false alarms signaled by the user's alarm system that occurs within a calendar year. The calendar year is defined as January 1 to December 31 of each given year. In the event of a second false alarm occurring within a calendar year, the alarm user shall be given written notice by the police department of the village's recording of the occurrence of two false alarms and advised of the penalty for a third or subsequent false alarm.

    Notwithstanding any penalty provided for any other violation of the village alarm systems ordinance, or the violation of any other ordinance of the village; and notwithstanding whether or not a prosecution has commenced, any person, corporation, partnership or other legal entity who uses, leases, installs or directs the installation of an alarm system as defined in the village alarm systems ordinance, as amended, shall be responsible to pay the following fines upon the occurrence of a false alarm as stated:

    (a)  Two false alarms requiring response by the police or fire department occurring within a calendar year: NO FINE
    (b)  Third false alarm requiring response by the police or fire department occurring within a calendar year: $ 50.00
    (c)  Fourth false alarm requiring response by the police or fire department occurring within a calendar year: 100.00
    (d)  Fifth false alarm requiring response by the police or fire department occurring within a calendar year: 200.00
    (e)  Sixth false alarm requiring response by the police or fire department occurring within a calendar year: 300.00
    (f)  Each and every false alarm requiring a response by the police or fire department in excess of six occurring within a calendar year: 500.00

     

    The fee or fees required to be paid pursuant to this section shall be paid within 30 days of the date of mailing of written notice to the alarm system user, which, if not paid, shall become a lien against the premises on which the alarm system is installed and shall be collectable by the village in any lawful manner, including, but not limited to, the manner in which delinquent property taxes are collected.
